1. General Provisions.
1.1. These terms and conditions of purchase and sale of goods (here in after – the Terms) are a binding legal document for the Parties, which establishes the rights, duties, and responsibilities of the Buyer when purchasing goods in the online store.
1.2. The Seller reserves the right to change, amend, or supplement the Terms at any time, considering the requirements set by legal acts. The Buyer will be informed on the online store's website. The Terms valid at the time of placing the order apply when the Buyer shops in the online store.
1.3. The following entities have the right to purchase in the online store:
1.3.1. legally competent natural persons, i.e., persons who have reached the age of majority and whose legal capacity has not been restricted by court order;
1.3.2. minors aged 14 to 18 years, only with parental or guardian consent, except in cases where they independently manage their income;
1.3.3. legal entities;
1.3.4. authorized representatives of all the above persons.
1.4. By confirming the Terms, the Seller also guarantees that, pursuant to clause 1.3 of the Terms, the Buyer has the right to purchase goods in the online store.
1.5. The contract between the Buyer and the Seller is considered concluded from the moment the Buyer, having formed a shopping cart in the online store, indicated the delivery address, chosen the payment method, and read the Seller’s Terms, clicks the “Confirm Order” button (see clause 5 “Ordering goods, prices, payment procedure, deadlines”).
2. Personal Data Protection.
2.1. The Buyer can order goods in the online store:
2.1.1. by registering on this online store – entering the requested registration data;
2.1.2. without registering on this online store.
2.2. When ordering goods by the methods specified in clause 2.1, the Buyer must provide necessary personal data for proper order fulfillment in the relevant fields provided by the Seller: name, surname, delivery address, phone number, and e-mail address.
2.3. By confirming these Terms, the Buyer agrees that the personal data provided in clause 2.2 will be processed for the purposes of selling goods and services in the online store, analyzing the Seller’s activities, and direct marketing.
2.4. By consenting to the processing of the Buyer’s personal data for the purposes of selling goods and services in the Seller’s online store, the Buyer also agrees to receive informational messages necessary to fulfill the order sent to the provided e-mail address and phone number.
2.5. By registering and ordering goods in the online store, the Buyer undertakes to keep login details confidential and not to disclose them to anyone.
3. Buyer’s Rights and Obligations.
3.1. The Buyer has the right to purchase goods in the online store in accordance with these Terms and other sections of this online store’s information.
3.2. The Buyer has the right to withdraw from the purchase and sale contract with the online store by notifying the Seller in writing (via e-mail, indicating the product to be returned and the order number) no later than 14 (fourteen) working days from the date of receipt of the goods, except in cases where withdrawal is not allowed by Lithuanian law (e.g., contracts for hygiene products – bedding items – see information on the Consumer Center’s website http://www.vartotojucentras.lt/istatymas.php?id=1038, “Peculiarities of non-food product returns and exchanges,” clause 18).
3.3. The right described in clause 3.2 may be exercised only if the product was not damaged or essentially changed in appearance and was not used.
3.4. The Buyer undertakes to accept the ordered goods and pay the agreed price.
3.5. If the data provided in the Buyer’s registration form changes, the Buyer must immediately update it.
3.6. The Buyer undertakes not to transfer login data to third parties. If the Buyer loses login details, they must immediately inform the Seller using the contact methods specified in the “Contacts” section.
3.7. By using the online store, the Buyer agrees to these purchase and sale Terms and undertakes to comply with them and not violate Lithuanian laws.
3.8. Contracts concerning non-standard products made (handrail posts, wall-mounted handrails, handrail sets, wooden handrails, powder-coated pipes) according to the User’s specifications or individual needs (e.g., when asked to make handrails or separate parts according to client dimensions) are non-returnable.
4. Seller’s Rights and Obligations.
4.1. The Seller undertakes to provide all conditions for the Buyer to properly use the services of the online store.
4.2. If the Buyer attempts to harm the stability and security of the Seller’s online store or violates their obligations, the Seller has the right to immediately and without warning restrict or suspend the Buyer’s ability to use the online store or, in exceptional cases, cancel the Buyer’s registration.
4.3. The Seller undertakes to respect the Buyer’s privacy rights regarding personal information provided in the online store registration form.
4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address indicated by the Buyer.
5. Ordering Goods, Prices, Payment Procedure, Deadlines.
5.1. The Buyer can purchase goods in the online store 24/7.
5.2. The contract becomes effective when the Buyer clicks the “Confirm Order” button and the Seller confirms the order by sending a confirmation e-mail to the Buyer’s provided e-mail address.
5.3. Prices of goods in the online store and the formed order are indicated in euros, including VAT.
5.4. The Buyer pays for the goods using one of the following methods:
5.4.1. Payment via electronic banking – advance payment using the Buyer’s electronic banking system. The Buyer must have signed an electronic banking agreement with one of the serviced banks. The money is transferred to the online store’s settlement account. Responsibility for data security lies with the respective bank as all transactions take place through the bank’s electronic banking system.
5.4.2. Payment by bank transfer – advance payment when the Buyer prints the order and goes to the nearest bank branch to transfer money to the online store’s bank account.
5.5. The Buyer undertakes to pay for the goods immediately. Only after payment is received does the formation of the shipment begin and the delivery deadline count start.
6. Delivery of Goods.
6.1. When choosing the delivery service during order placement, the Buyer must specify the exact delivery location.
6.2. The Buyer undertakes to receive the goods personally. If the Buyer cannot personally accept the goods but the goods are delivered to the specified address, the Buyer has no right to make claims to the Seller regarding delivery to an incorrect recipient.
6.3. Goods are delivered by the Seller or the Seller’s authorized representative (courier).
6.4. The Seller delivers the goods to the Buyer following the terms specified in the product descriptions. These terms are preliminary and do not apply if the Seller’s stock lacks the required goods; in such cases, the Buyer is informed about the shortage. The Buyer also agrees that in exceptional cases, delivery may be delayed due to unforeseen circumstances beyond the Seller’s control. In such cases, the Seller undertakes to immediately contact the Buyer and arrange delivery terms.
6.5. The Seller is exempt from liability for breach of delivery deadlines if goods are not delivered or are delivered late due to the Buyer’s fault or circumstances beyond the Seller’s control.
6.6. The Buyer must immediately inform the Seller if the shipment is delivered in damaged or otherwise compromised packaging, if unordered goods or incorrect quantities or incomplete sets are included in the shipment.
6.7. The Buyer who notices packaging damage at delivery must note the damage in the courier’s delivery document or draw up a separate report about the damage, in the presence of the courier. Failure to do so releases the Seller from liability for damage related to packaging that the Buyer did not mark in the courier’s delivery document.
7. Quality of Goods, Warranty.
7.1. Information about each product sold in the online store is generally provided in the product description.
7.2. The Seller is not responsible if goods in the online store differ in color, shape, or other parameters from the actual size, shape, and color due to the characteristics of the Buyer’s display.
7.3. The Seller provides a quality warranty for certain types of goods, with specific terms and conditions indicated in the descriptions of such products.
7.4. If the Seller does not provide a warranty for certain products, the warranty prescribed by applicable laws applies.
8. Returns and Exchanges.
8.1. Defects of sold goods are corrected, and defective goods are exchanged or returned in accordance with the Rules of Return and Exchange of Goods approved by the Order No. 217 of the Minister of Economy of the Republic of Lithuania dated June 29, 2001, except in cases where withdrawal is not allowed under Lithuanian law (e.g., hygiene products – bedding items – see Consumer Center info).
8.2. The Buyer may return goods in original packaging and unused condition within 14 calendar days from the date of receipt.
8.3. The Buyer must send the returned goods to the Seller’s address or bring it in person, attaching a filled Return Form.
8.4. The Seller must refund the price paid by the Buyer within 14 calendar days from the date of receipt of the returned goods.
9. Liability.
9.1. If the Buyer violates these Terms, they bear responsibility according to applicable laws.
9.2. The Seller is responsible for quality and timely delivery of the goods, except for cases specified in clause 6.5.
9.3. The Seller is not responsible for damages caused by improper use or storage of goods by the Buyer.
10. Final Provisions.
10.1. Disputes between the Seller and the Buyer arising from these Terms will be resolved by negotiation. If an agreement cannot be reached, disputes are resolved by courts of the Republic of Lithuania.
10.2. These Terms are governed by the laws of the Republic of Lithuania.
10.3. In case any clause of these Terms is declared invalid, other provisions remain in force.
10.4. The Terms come into force on the date of their publication on the online store website and apply to all orders placed after this date.
