1. General Provisions
1.1. These Rules of Purchase and Sale of Goods (here in after referred to as the Rules) are a binding legal document for the Buyer and the Seller (hereinafter referred to as the Seller), which set out the rights and obligations of the parties, the conditions for purchasing and paying for goods, the procedure for delivery and return of goods, as well as other terms related to the purchase and sale of goods in the online store www.ecoshop.lt.
2. Conclusion of the Purchase and Sale Agreement
2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded from the moment the Buyer, after forming a shopping cart in the e-shop, specifying the delivery address, choosing a payment method, and familiarizing themselves with these Rules, clicks the "Confirm Order" button.
2.2. Each purchase and sale agreement concluded between the Buyer and the Seller is registered and stored in the www.ecoshop.lt e-shop database.
3. Buyer's Rights
3.1. The Buyer has the right to purchase goods in the e-shop according to the procedure established by these Rules.
3.2. The Buyer has the right to withdraw from the purchase and sale agreement concluded with the www.ecoshop.lt e-shop by notifying the Seller in writing (by email, indicating the desired returned product and order number) no later than within 14 (fourteen) working days from the day of delivery of the item, unless the agreement cannot be withdrawn from according to the laws of the Republic of Lithuania (e.g., in cases of contracts for perishable goods, etc.).
3.3. Rule 3.2 is not applicable to hygiene products, cosmetics, and perfumery, if they were used at least once or if their original packaging was opened or damaged.
3.4. The Buyer also has other rights provided by the legal acts of the Republic of Lithuania.
4. Buyer's Obligations
4.1. The Buyer must pay the agreed amount for the purchased goods and accept them according to the procedure established by these Rules.
4.2. The Buyer must not transfer their login data to third parties. If the Buyer loses login data, they must immediately inform the Seller via the means of contact specified in the "Contacts" section.
4.3. If the data provided in the Buyer's registration form changes, the Buyer must update it immediately.
4.4. The Buyer, using the www.ecoshop.lt e-shop, agrees to these Rules and must comply with them.
5. Seller's Rights
5.1. If the Buyer attempts to harm the operation or stable functioning of the e-shop, the Seller may, without prior notice, restrict, suspend (temporarily or indefinitely) the Buyer's ability to use the e-shop.
5.2. The Seller has the right, without prior notice to the Buyer, to cancel the Buyer's order if the Buyer does not pay for the goods within 3 (three) working days.
5.3. The Seller has the right to cancel the Buyer's order if the specified contact information is incorrect or if it is impossible to contact the Buyer.
5.4. The Seller has the right to cancel the Buyer's order if the goods are not available in the warehouse, or if due to technical system errors, an incorrect price of the goods was displayed in the e-shop.
5.5. The Seller also has other rights provided by the legal acts of the Republic of Lithuania.
6. Seller's Obligations
6.1. The Seller undertakes to allow the Buyer to use the services provided by the e-shop www.ecoshop.lt under the conditions set out in these Rules.
6.2. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer under the conditions set out in these Rules.
6.3. The Seller, due to important circumstances, being unable to deliver the ordered goods to the Buyer, undertakes to offer a similar product or return the paid money to the Buyer within 3 (three) working days if the Buyer refuses a similar product.
6.4. The Seller undertakes to respect the Buyer's right to privacy concerning the Buyer's personal information indicated in the e-shop registration form.
6.5. The Seller undertakes to comply with the other requirements set by the legal acts of the Republic of Lithuania.
7. Prices of Goods, Payment Procedure, and Terms
7.1. The prices of goods in the e-shop and the formed order are indicated in euros.
7.2. The Buyer pays for the goods in one of the following ways:
7.2.1. Using electronic banking;
7.2.2. By bank transfer to the Seller's account;
7.2.3. Using other payment methods indicated in the e-shop.
7.3. Only upon receiving the payment for the goods, the order is confirmed, and the delivery term begins.
8. Delivery of Goods
8.1. The Buyer undertakes to specify the exact delivery address.
8.2. The Buyer undertakes to accept the goods personally. If the Buyer cannot personally accept the goods, but the goods are delivered to the specified address, the Buyer has no right to make claims regarding the delivery to the wrong person.
8.3. The goods are delivered by the Seller or an authorized representative (courier).
8.4. The Seller delivers the goods to the Buyer according to the conditions indicated in the product descriptions. These terms are preliminary and do not apply in cases where the Seller does not have the required goods in stock, and the Buyer is informed about the shortage of ordered goods. In addition, the Buyer agrees that in exceptional cases, the delivery of goods may be delayed due to unforeseen circumstances beyond the Seller's control.
8.5. When returning goods, the Buyer covers the costs of returning the goods.
8.6. When returning incorrect and/or defective goods, the Seller undertakes to accept such goods and replace them with suitable goods. If the Seller does not have similar goods, the money paid for the goods is returned to the Buyer.
9. Responsibility of the Buyer and Seller
9.1. The Buyer is fully responsible for the accuracy of the personal data provided. If the Buyer fails to provide accurate personal data, the Seller is not liable for the resulting consequences and has the right to claim direct damages from the Buyer.
9.2. The Buyer is responsible for actions performed using the e-shop.
9.3. The registered Buyer is responsible for the transfer of login data to third parties. If third parties use the services of the e-shop using the Buyer's data, the Seller treats such person as the Buyer.
9.4. The Seller is not liable for losses resulting from the Buyer's failure to familiarize themselves with these Rules despite being given such an opportunity.
9.5. If the Seller's e-shop contains links to other companies', institutions', organizations', or individuals' websites, the Seller is not responsible for the information or activities carried out there, nor does he supervise or control those websites.
9.6. In the event of damage, the guilty party compensates the other party for direct losses.
10. Marketing and Information
10.1. The Seller may initiate various promotions in the e-shop at his own discretion.
10.2. The Seller has the right to unilaterally change the terms of promotions as well as cancel them without a separate notice. Any changes or cancellations of promotion conditions are effective from the moment they are made.
10.3. The Seller sends all notifications to the Buyer via the email address provided in the Buyer's registration form.
10.4. The Buyer sends all messages and questions to the Seller using the means specified in the "Contacts" section of the e-shop.
10.5. The Seller is not responsible if the Buyer does not receive sent informational or confirmation messages due to issues with the internet connection, email service providers, or the Buyer providing incorrect data.
11. Final Provisions
11.1. These Rules are prepared in accordance with the legal acts of the Republic of Lithuania.
11.2. All disputes arising from the implementation of these Rules shall be resolved through negotiations. If no agreement is reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
